Critical Issues: Encryption & Going Dark
Criminals of all types, including terrorists, are taking advantage of encrypted technology that allows them to operate in the shadows, undetected by law enforcement and the intelligence community. Crime scenes from terrorist attacks, homicides, kidnappings, assaults, and incidents of domestic violence now, more often than not, include digital communications evidence. Digital footprints are the modern-day fingerprint that law enforcement uses to protect the public. With the continued development of new technologies and strategies established to advance network security, law enforcement, prosecutors, and other investigators are finding it increasingly difficult to execute lawful court orders to obtain critical digital evidence. The inability of law enforcement to overcome these barriers (known as “Going Dark” in the law enforcement community) has presented real challenges. This page will serve as a clearinghouse of resources to help guide law enforcement as they are confronted with difficult questions related to “Going Dark.”

Data, Privacy, and Public Safety: A Law Enforcement Perspective on the Challenges of Gathering Electronic Evidence
In 2015, the IACP convened a Law Enforcement Summit on “Going Dark” to help identify legal, technical, and operational concerns associated with the issues surrounding the gathering and use of data related to communications and mobile devices. A broad array of law enforcement leaders, investigators, and subject matter experts participated in the summit.
The summit report, reviews the current capabilities of law enforcement agencies, the impact that technological advances are having on law enforcement investigations, and the role of industry in this debate. The summit report also makes clear that our laws have failed to keep pace with new technology and that urgent and immediate action needs to be taken.
International Association of Chiefs of Police Firearms Position Paper
The International Association of Chiefs of Police (IACP) has long held positions intended to reduce and prevent firearms violence. Crime Gun Information Sharing: The ATF i-Trafficking Project Integration of Firearms Trace/Ballistic Data into Fusion Center Intelligence Sharing (2014)
The IACP, in partnership with DOJ U.S. Department of Justice and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) led and an assessment of the Interstate Trafficking Program (iTrafficking), to promote a regional approach to firearms trafficking investigations. By analyzing key fusion centers in the northeast region of the United States (New York, Pennsylvania, Delaware, and Maryland) to analyze crime gun data, the goal of this project was to develop an innovative, multi-state approach to reducing violent crime through shared resources and increased collaboration. The information contained in this report are useful in guiding fusion center personnel, as well as state, local, and tribal law enforcement, in the utility and examination of firearms trace data for intelligence products, criminal investigations, and prosecutions.
International Association of Chiefs of Police Firearms Position Paper (2018)
The IACP has long advocated for the adoption of common sense policies that will assist in reducing gun violence. These proposals were drawn from the association resolutions and policy positions adopted by the IACP membership.
This guide provides information about notable programs and policing strategies that can be implemented by law enforcement agencies, regardless of size, in order to enhance the critical and life-saving mission of reducing gun violence. By highlighting innovative approaches developed by law enforcement departments and communities across the country, local leaders are encouraged to expand upon their current efforts in order to create a comprehensive program to enhance community and officer safety.
Taking a Stand: Reducing Gun Violence in Our Communities (2007)
This report focuses on recommendations on three main areas: keeping communities safe by improving public understanding about the risks of gun violence; preventing and solving gun crime by stopping the flow of illegal guns, and keeping police officers safe by improving training and support for officers in handling guns.
Police Officer’s Guide to Recovered Firearms Mobile Application
The IACP, in collaboration with the Department of Justice (DOJ) Bureau of Justice Assistance (BJA), the IACP Firearms Committee, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) developed a mobile application (app) designed to assist law enforcement officers with processing recovered firearms. The app has been downloaded over 25,000 times and features information on firearms safety, firearms marking identification tools, firearms tracing tools, and other valuable information.

Responding to individuals who have mental illness or are in crisis is an increasing challenge and an important issue. One Mind Campaign
Launched in 2016, the One Mind Campaign seeks to ensure successful interactions between police officers and persons affected by mental illness. Participating law enforcement agencies have pledged their commitment to implement four promising practices, including partnering with a community mental health organization, implementing a policy to address police response to persons affected by mental illness, and provision of CIT and MHFA training.
The One Mind Campaign was borne out of an advisory group convened by the IACP to discuss the problem and create a set of recommendation to help agencies effectively manage their officers' response to persons affected by mental illness. Two documents summarize the work and recommendations of that advisory group:
Building Safer Communities: Improving Police Response to Persons with Mental Illness
In May 2009, the IACP, in collaboration with the Bureau of Justice Assistance of the U.S. Department of Justice, JEHT Foundation, and the Substance Abuse and Mental Health Services Administration of the Department of Health and Human Services held a National Policy Summit on Building Safer Communities: Improving Police Response to Persons with Mental Illness. As a result of the summit, a report was produced that makes recommendations for local, state, federal, and tribal organizations to enhance the safety of community members and law enforcement officers when responding to crisis calls involving a person with mental illness.

Partnerships in Pretrial Justice: A Law Enforcement Leader's Guide to Understanding and Engaging in Meaningful Front-End Justice System Change
As more states and local communities discuss and implement pretrial justice system changes, it is critical for law enforcement to have a voice in these conversations to ensure that policies and procedures are fair, efficient, and keep officers and communities safe. The new publication includes talking points for law enforcement, resource links, and information about evidence-based pretrial strategies, including risk assessment, citation in lieu of arrest, diversion, and enhanced pretrial release monitoring.
Pretrial Justice and Law Enforcement: What Chiefs Need to Know and What Officers Need to Know
These online courses give an overview of the complexities of the pretrial justice system and explore risk-based solutions and pretrial partnerships that maximize public safety and support strong community-police relationships.
Citation in Lieu of Arrest (2016)
The IACP, with support from the Laura and John Arnold Foundation, undertook a three-pronged assessment (literature review, nationwide survey, and focus groups) to study how police departments approach the use of citation in lieu of arrest, with a goal to provide the law enforcement community and other criminal justice stakeholders with a reference point for information about citation practices across America.

The IACP, with support from the Laura and John Arnold Foundation, undertook a three-pronged assessment (literature review, nationwide survey, and focus groups) to study how police departments approach the use of citation in lieu of arrest. In addition to a full report, a trifold guide was developed that highlights the key findings.
Supporting Victims through Pretrial Justice Reform (2015)
The IACP Victim Services Committee identified pretrial release/detention as a decision point in the criminal justice system that could be improved to better meet the needs of victims. The intent of this briefing paper is to raise awareness and prompt informed discussion among law enforcement and other criminal justice leaders about how the pretrial justice system could be improved to be more responsive to victims.
Law Enforcement’s Leadership Role in Pretrial Justice Reform (2011)
In partnership with BJA and the Pretrial Justice Institute, IACP hosted a focus group discussion about law enforcement’s role in pretrial justice system change. The report includes an overview of the historic and current bail system and recommendations on how law enforcement can work with their justice system partners to support risk-based pretrial alternatives that enhance public and officer safety.
Safety and Justice Challenge
The John D. and Catherine T. MacArthur Foundation has selected the IACP to serve as a strategic ally to support their Safety and Justice Challenge, an initiative aimed at reducing incarcerated populations. The IACP will support participating Challenge jurisdictions and law enforcement agencies throughout the country in identifying and developing promising law enforcement strategies for safely reducing arrests and incarceration.
